Court Rulings on Gun Industry Immunity

INDIANA COURT DECLARES GUN INDUSTRY IMMUNITY LAW UNCONSTITUTIONAL

One year ago, Congress passed a law preventing gun violence victims from having their day in court against negligent gun manufacturers; the so-called "Protection of Lawful Commerce in Arms Act." A recent ruling in Indiana found that the law violates Due Process and Separation of Powers provisions under the Constitution. There are several pending cases challenging the constitutionality of this law - Indiana's Superior Court was the first to rule the law unconstitutional.

Case brought by families of 1999 JCC shooting victims highlights folly of legal immunity for gun industry

The Supreme Court of the United States declined to grant certiorari to review the Ninth Circuit Court of Appeals' decision to reinstate the Ileto v. Glock suit against certain gun industry members. The case has returned to the trial court for further proceedings.
